FTX’s Bankman-Fried could ‘conceivably’ have bail revoked, says judge

A federal judge said there was “probable cause” to believe that SBF engaged in activities that could land him in jail until his trial in October.

Rob Bankman-Fried's bail is likely to be revoked after a federal presiding judge said there was "probable reason" to believe that the former FTXCEO was probably involved in an attempt to falsify witnesses.

According to several reports, at a hearing on Bankman-Fried's bail request on February 16th, Chief Justice Lewis Kaplan indicated that there may be reason to believe that he (Bankman-Fried) committed or tried to commit the federal crime of falsifying witnesses during his release from prison.

Kaplan said it might be "not hard to imagine" seeing the FTX founder sent to a detention center until he was sentenced in October.

However, Kaplan stressed that the Feb. 16 hearing was not a bail revocation hearing, but he added that it is not difficult to imagine that it is also possible.

Kaplan is reported to have said: "Why am I required to release him in the park of this electronic device?"

Law professor Richard Painter echoed this view in a tweet on February 17, pointing out that because of his current situation, falsifying witnesses may not be a good idea:

On Feb. 15, prosecutors ordered Judge Kaplan to further control the operation of Bankman-Fry devices on a monitored computer and mobile phone.

Prosecutors stressed that Bankman-Fried's recent use of mobile phones was worrying and tried to further restrict and regulate its use, "with the exception of limited resources."

At the hearing, Judge Kaplan made it clear that because Bankman-Fried lived with his family and they had laptops, it was innocent to think that these restrictions would prevent the use of the Internet.

Prosecutor Niedpros seemed to allow it, hinting that there should be no "excellent solution", prompting Kaplan to suggest that withdrawing bail for Bankman-Fry would eliminate these risks and stressed:

"there is still a solution, but no one has clearly put forward it."

But lawyer Bankerman-Fried made up lies and asked him to defend himself, claiming: "without him, no one can read this wide range of accounting records."

Since Feb. 9, the former FTXCEO has been banned from using instant messaging because she was found to have contacted an invisible witness. He was also temporarily banned from VPN after prosecutors accused her of using VPN twice on January 29th and February 12th.

At the hearing on February 16th, VPN restrictions were not increased.

Many people inside and outside the password world are not convinced that under such circumstances, Bankman-Fried's bail has not been revoked.
