Celsius Failed to Record Some 7,000 Intercompany Transfers Worth Billions Leading Up to Bankruptcy

A lack of record-keeping could make it impossible to "fully reconstruct" the bankrupt crypto lender's multi-billion-dollar intercompany claim, court filings show.

The bankrupt login password lender Celsius Network did not adequately record transactions between its affiliated companies, making it almost impossible to "completely restore" claims between companies, according to court documents on Thursday.

Celsius Network LLC filed a statement on Thursday proving the amount and type of potential claims it has against its affiliates in response to a court order from a bankruptcy court in New York City on Feb. 9.

Celsius Network LLC's intercompany claim of approximately $9.1 billion against Celsius Network Limited (CNL) based on books and records "does not take into account defects at the record storage level"-including the possibility of 7000 unrecorded transactions between the two physical lines in the three months prior to the filing of the bankruptcy filing.

Earlier this week, Celsius submitted a sale plan to the court to facilitate the company's reorganization after it filed for bankruptcy under Chapter 11 in July. The statement filed on Thursday reflects the company's books as of the July 14 bankruptcy filing date.

A review of the company's books showed that, "in most cases", there was no record of intercompany transfers at all-7000 unrecorded transfers "could not be reflected through intercompany transactions in the financial books and records".

"due to the lack of record storage, is it possible to completely resume claims between companies," the statement said. "if it is completely possible, it will be a matter of spending a lot of time and cost in forensic accounting, and it is very likely that a forensic accountant company will have to be hired to manually restore every intercompany transaction, which will bring huge costs to the debtor's property."

According to the document, through a "several-month analysis", the best possible amount of all the claims explicitly filed by LLC against CNL could be $3.5 billion.
